Training Terms and Conditions

  1. Terms and conditions:
    1. The terms and conditions shall exclude all other terms and conditions, subject always to any rights and liabilities imposed by statute. Any alterations or variations shall be of no effect unless agreed by a senior representative of the company in writing. No other employee, representative or agent has the authority to vary, alter or amend these conditions in any way whatsoever.
  2. Bookings:
    1. Bookings can be made via email to training@marys.org.uk or online.
    2. Once a course date has been agreed, the booking will only be confirmed once the payment has been made in full.
    3. The company will accept orders if they are in writing on an adequately constituted order from the Purchaser.
    4. Verbal enquiries and orders are accepted only when the company receives written confirmation from the Purchaser within 48 hours of the verbal order or enquiry.
  3. Payment:
    1. For all private courses, full payment must be received 28 days before the course’s start date.
    2. Payment can be made via BACS. Details can be found on any invoice we issue. Please use the company name and customer reference number as bank references.
    3. For all bookings made via our website, individuals must make payment at the time of booking by debit/credit card.
  4. Cancellations
    1. No fee is charged for bookings cancelled by more than 43 days (6 weeks) prior to the course start date.
    2. A 50% fee is charged for bookings cancelled within 15-42 days (2 – 5 weeks) prior to the course start date.
    3. A full fee is charged for cancellations received within 14 days (2 weeks) or less prior to the course start date.
    4. Cancellation requests must be made in writing and acknowledged by Mary’s by the due date.
  5. Transfers
    1. Transfers are subject to availability and requests must be made in writing and acknowledged by Mary’s by the due date.
    2. No fee will be incurred to first transfer made by more than 43 days (6 weeks) prior to the course start date. Any subsequent transfers will incur a 50% fee.
    3. A 25% fee is charged for bookings transferred within 15-42 days (2 – 5 weeks) prior to the course start date.
    4. A 50% fee is charged for bookings transferred within 14 days (2 weeks) or less prior to the course start date.
    5. Unless there is prior agreement, the client must confirm course transfer dates within 7 days. Cancellation fees apply otherwise.
  6. Failure to Show: 
    1. Any delegate failing to attend without notice will still reflect a bonafide booking and the full fee will remain payable for the course not attended. A further course fee will be payable if a re-booking is made.
    2. If a delegate fails to attend due to on the day illness, the payment will be reviewed at the discretion of Mary’s.
  7. Course Timings & Attendance:
    1. Delegates must adhere to timings as stipulated on the course confirmation. Failure to attend part of the course could result in the delegate’s not meeting qualification requirements where applicable.
    2. The Purchaser acknowledges that if a delegate arrives late for a course or is absent from any session, Mary’s reserves the right to refuse to accept the delegate for training — if it decides in its sole discretion that the delegate will gain insufficient knowledge or skill in the time remaining.
    3. In all such cases, the full course fee remains payable.
    4. Where compliance with Health and Safety Executive (HSE) or other regulatory body requirements for statutory certificates, attendance at all sessions is mandatory.
  8. Fitness to Attend:
    1. Delegates placed on any course must be free from ailment, condition or injury that will affect their ability to participate during the practical aspects of the course.
    2. The delegate must also be fit and have the right attributes for the nature of the training.
    3. All delegates must have a competent spoken and written English level to understand the teaching and undertake written examinations.
    4. Delegates on a Refresher or Re Qualification course must be in possession of a First Aid at Work certificate valid within 28 days of the course start date.
  9. Certificates:
    1. For all accredited courses, the initial issue of an e-certificate is included in the course fee.
    2. Certificates are sent to the delegate’s email address when they are available. Otherwise, they are sent to the Purchaser.
    3. Claims for certificate errors must be made in writing within 28 days of the date of issue of the certificate.
    4. Delegates can, at any time while the certificate is valid, be issued a hard copy of their certificate for an extra cost of £10.00 per certificate.
    5. Any discrepancies’ regarding certificates made after 6 weeks of the course date, will be investigated at the discretion of Mary’s.
    6. We reserve the right not to issue certificates where an invoice remains unpaid.
  10. Companies Booking Private Onsite Training — Training Space Requirements:
    1. For the First Aid Training
      1. The space being used for the training must be large enough (40 square meters) to accommodate all delegates attending the course, typically 10 to 12 people, with sufficient room for groups of students to practice practical aspects that involve kneeling or lying on the floor.
      2. Measurements of the room can be adjusted in accordance with the number of delegates attending, at the discretion of Mary’s.
      3. Basic sanitary facilities must be available to use for trainers and delegated.
      4. Please note: Trainers have the right to refuse to carry out training where the training space is either too small or not suitable. No refunds will be available if a trainer refuses to carry out the training as above.
  11. Force Majeure:
      1. Mary’s cannot be held responsible for any incident or occurrence outside its control that affects the provision of any given course date, course forecast, course content or course timing, and/or including cancellation, amendment or re-scheduling. Where a course content or course timing must be amended/cancelled/re-scheduled, Mary’s will make every reasonable effort to make alternative arrangements.
  12. Right of Admission:
      1. Mary’s reserves the right to refuse admission to any delegate exhibiting unruly or anti-social behaviour to either its staff or other delegates. Any such incident will result in the immediate exclusion of the delegate.
  13. Complaint’s Procedure:
      1. On a very rare occasion, issues may arise as a result of misunderstandings and can be easily resolved. However, we recognise that there may be times when you feel that our service has not met your expectations and wish to raise this as a formal complaint. Please email us at ‘training @ marys.org.uk’ with any feedback.
  14. Personal property
      1. Mary’s does not accept responsibility for the loss of personal property belonging to the delegates while attending any of our courses.
  15. Insurance
      1. We hold professional liability and public liability insurance.
